By using our website, you agree to be bound by these Terms and Conditions (“Terms”). These Terms govern the use of our platform by customers booking fishing trips and fishing charter operators (“Captains”) listing their services. Please read these Terms carefully before using our services.
1. Overview of Barbarian Outdoor
Barbarian Outdoor is an online platform that connects customers seeking fishing trips with fishing charter operators in Hong Kong. Captains can sign up and list their boats for fishing trips, and customers can browse, select, and book fishing trips through our website. To confirm a booking, customers must pay a deposit through the platform. The remaining balance is paid in cash directly to the Captain on the date of the fishing trip.
2. Eligibility
Customers must be at least 18 years old to book a fishing trip through Barbarian Outdoor.
The eligibility of infants (under 2 years) and children (aged 2–12) depends on the Captain’s policy, displayed during booking. Customers must review this policy to confirm if infants or children are allowed.
If permitted by the Captain, infants under 2 years do not count toward the guest number.
If permitted by the Captain, children aged 2–12 are counted as adults (aged 13 and above) and pay the full trip price.
3. Booking Process
Exploring and Booking: Customers can browse fishing trips on https://barbarianoutdoor.com/ and select their preferred trip.
Captain Review: After a booking request is submitted, the Captain will promptly assess and decide whether to accept or decline, considering factors such as weather conditions, availability, and the ability to meet customer preferences.
Deposit Payment: To secure a booking, customers must pay a deposit through the platform, with the amount clearly indicated during booking.
Balance Payment: The remaining trip cost is paid in cash directly to the Captain on the trip date, unless otherwise specified.
4. Payment Terms
Deposit: The deposit is paid through the Barbarian Outdoor platform at the time of booking confirmation. The deposit amount is set by the Captain and displayed during the booking process.
Remaining Balance: The remaining balance is paid in cash directly to the Captain on the date of the fishing trip, unless otherwise agreed.
Barbarian Outdoor is not responsible for disputes regarding cash payments made directly to Captains. Customers are advised to request a receipt for any cash payments.
5. Cancellation and Refund Policy
All cancellations must be processed according to the methods outlined below and are effective only upon confirmation by Barbarian Outdoor. Refunds are subject to our Refund Policy.
5.1 Customer Cancellations
Cancellations by customers are governed by the individual Captain’s cancellation policy, which will be clearly displayed during the booking process. Policies may vary, including options for no refunds or refunds under specific conditions. Customers are encouraged to review the Captain’s policy before confirming their booking.

5.2 Captain Cancellations
Captains may cancel a booking due to the following reasons:
Bad weather conditions that make the trip unsafe.
Mechanical issues with the boat that prevent the trip from proceeding.
Failure to meet the minimum guest number for a shared trip.
In such cases, customers will receive a full refund of their deposit.
If a Captain cancels for reasons other than those listed above, the following consequences may apply:
The Captain will receive an automatic negative review for the cancellation.
The Captain’s ranking on the platform may be lowered.
The Captain may receive a warning from Barbarian Outdoor.

Repeated cancellations for reasons not listed above may result in the Captain’s removal from the platform.
6. Responsibilities of Customers
Customers must provide accurate information during the booking process, including the number of guests and any special requirements.
Customers must ensure they meet the Captain’s safety and eligibility requirements, including policies on infants and children, age restrictions, physical fitness, or equipment needs.
Customers must arrive at the designated meeting point on time and follow the Captain’s instructions during the fishing trip.
Customers are responsible for paying the remaining balance in cash to the Captain on the day of the trip.
Seasickness: Customers who may experience seasickness are responsible for bringing their own medication, as Barbarian Outdoor and its Captains do not provide seasickness remedies. Refunds will not be issued if a customer’s trip experience is affected by seasickness.
7. Responsibilities of Captains
All Captains listed on Barbarian Outdoor operate Class IV vessels, as classified by the Hong Kong Marine Department. These vessels must hold a valid Operating Licence (OL) endorsed to be let for hire or reward, in compliance with the Hong Kong Marine Department’s regulations.
All vessels are required to carry Compulsory Third Party Risks Insurance, as mandated by Hong Kong law.
Captains must provide accurate, up-to-date information about their fishing trips, including pricing, availability, boat details, guest requirements, and their policy on infants and children.
Captains must review and respond to booking requests as promptly as possible, considering weather forecasts, availability, and customer request fulfillment.
Captains are responsible for ensuring their boats are safe, seaworthy, and compliant with all applicable Hong Kong maritime regulations.
Captains must clearly communicate their cancellation policies, infant and child policies, and any specific requirements (e.g., minimum guest numbers for shared trips) at booking.
8. Safety and Liability
Customers participate in fishing trips at their own risk. Barbarian Outdoor is not responsible for any injuries, damages, or losses incurred during a fishing trip.
Captains are responsible for ensuring the safety of their guests and maintaining their boats in a seaworthy condition, in compliance with Hong Kong Marine Department regulations.
Customers must follow all safety instructions provided by the Captain, including wearing life jackets and adhering to safety protocols.
Barbarian Outdoor is not liable for any accidents, injuries, or damages caused by the negligence of Captains or customers.
9. Reviews and Rankings
Customers may leave reviews for Captains based on their fishing trip experience. Reviews must be honest, fair, and compliant with our review guidelines.
Captains’ rankings on the platform are determined based on customer reviews, cancellation history, and overall performance.
Negative reviews or rankings due to cancellations (as outlined in Section 5.2) are final and cannot be appealed, except in cases of platform error.
10. Intellectual Property
All content on the Barbarian Outdoor website, including text, images, logos, and designs, is the property of Barbarian Outdoor or its licensors and is protected by copyright and other intellectual property laws.
Users may not reproduce, distribute, or modify any content from the website without prior written permission from Barbarian Outdoor.
11. Privacy
Barbarian Outdoor collects and processes personal information in accordance with our Privacy Policy. By using our platform, you consent to the collection and use of your personal information as described in the Privacy Policy.
12. Termination
Barbarian Outdoor reserves the right to suspend or terminate a user’s access to the platform (whether a customer or Captain) for violating these Terms, engaging in fraudulent activity, or for any other reason at our discretion. Captains who repeatedly violate cancellation policies or receive negative reviews may be removed from the platform.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any disputes arising from these Terms or the use of the Barbarian Outdoor platform will be subject to the exclusive jurisdiction of the courts of Hong Kong.
14. Changes to These Terms
Barbarian Outdoor reserves the right to update or modify these Terms at any time. Changes will be posted on this page with an updated “Last Updated” date. Continued use of the platform after changes to the Terms constitutes acceptance of the revised Terms.
